Terms of Use
1. Acceptance
These Terms of Use govern your use of SoStonks ("SoStonks," "the app," "we," "our," or "us"), a strategy backtesting and chart analysis app for iOS and iPadOS. By downloading, installing, or using the app, you agree to these terms. If you do not agree, do not use the app.
SoStonks is distributed through the Apple App Store, and Apple's Licensed Application End User License Agreement also applies to your use of the app. Where these terms and Apple's terms conflict, Apple's terms govern to the extent of the conflict.
2. What SoStonks Is
SoStonks is a research and education tool. It lets you build a set of trading rules and test them against historical price data on your device, then read a report of what those rules would have done in the past.
SoStonks does not place trades, does not connect to any broker or exchange account, and never has access to your money. Nothing in the app is an order, a signal to act, or a recommendation to buy or sell any instrument.
3. Not Financial Advice
SoStonks does not provide investment, financial, legal, or tax advice, and nothing in the app should be read as such. Backtest results describe the past under a set of assumptions; they are not a prediction and do not guarantee any future outcome. Trading carries risk, including the risk of losing your entire capital. You are solely responsible for your own trading and investment decisions, and you should consider seeking advice from a licensed professional before acting.
4. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, in line with the App Store Terms of Service. You may not copy, modify, reverse-engineer, decompile, resell, or redistribute the app or any part of it, except where such restriction is prohibited by law.
5. In-App Purchases
SoStonks offers an optional one-time purchase, SoStonks Pro, that unlocks additional features. It is a non-consumable purchase, not a subscription, and is billed once through your Apple ID. You can restore it on any device signed into the same Apple ID. Purchases are handled entirely by Apple; refunds are subject to Apple's policies, not ours.
6. Third-Party Data
The app retrieves historical market data from third-party sources, including Binance, Bybit, OKX, Yahoo Finance, and Stooq. That data is provided by those third parties "as is." It may be delayed, incomplete, adjusted, or inaccurate, and it may change or become unavailable without notice. We do not control these sources and do not warrant the accuracy of their data. You may also load your own data from a CSV file, in which case its accuracy is your responsibility.
7. Assumption of Risk
You use SoStonks, and any results or exports it produces, at your own risk. Any decision you make on the basis of the app, including any real trade, is made by you alone and at your own risk.
8. Disclaimer of Warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any result it produces is correct or reliable.
9. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or trading capital, arising out of or related to your use of the app, even if we have been advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law.
10. Acceptable Use
You agree to use the app only for lawful purposes and not to misuse it, interfere with its operation, or attempt to access it in a way these terms do not permit.
11. Changes
We may update the app and these terms from time to time. Material changes to these terms will be reflected by updating the "Last Updated" date above. Continued use of the app after a change takes effect means you accept the revised terms.
12. Governing Law
These terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
